Italy Bans ChatGPT Due to Alleged Privacy Violations

In Brief
Italian regulators ban AI language model ChatGPT due to concerns over data privacy and the app’s availability to minors.
The Italian DPA said ChatGPT violated the European Union’s General Data Protection Regulation (GDPR).
Italy’s data protection agency has recently opened an investigation into OpenAI’s popular chatbot, ChatGPT, over concerns regarding its data collection practices.
The app, which is financially backed by Microsoft, has also been accused of failing to check the age of its users, despite being intended for use by individuals aged 13 and over. As a result, the Italian privacy regulator has ordered a temporary ban on ChatGPT until OpenAI can demonstrate compliance with the EU’s General Data Protection Regulation (GDPR).
Italy’s regulators emphasized: “As evidenced by the checks carried out, the information provided by ChatGPT does not always correspond to the real data, thus determining an inaccurate processing of personal data.”
The agency also referred to a recent data breach in which users reported being able to access the chat histories of other individuals.
“OpenAI, which does not have an office in the Union but has designated a representative in the European Economic Area, must communicate within 20 days the measures undertaken in the implementation of what is requested by the Guarantor, under penalty of a fine of up to 20 million euros or up to 4% of the annual global turnover,”
Italian DPA further wrote.
Many people are calling for a halt to new ChatGPT releases and an investigation into OpenAI due to privacy concerns, cybersecurity issues, and disinformation. Elon Musk and other AI experts have called for a pause, while the BEUC consumer advocacy group has asked EU and national authorities, including data protection watchdogs, to investigate the chatbot.
However, OpenAI is not resting on its laurels. Having recently launched its latest language model version, GPT-4, the company now aims to achieve AGI with the upcoming GPT-5 in the near future.
