Spain Raises the Alarm on OpenAI’s ChatGPT Privacy Concerns, Urges EU Action

The Spanish data protection agency (AEPD) has requested that the European Union’s privacy watchdog assess the privacy issues related to ChatGPT, the AI-powered chatbot developed by OpenAI. This request follows growing global scrutiny of AI systems.
According to Reuters, which interviewed a spokesperson for the AEPD, Spain’s agency has acknowledged the need for coordinated decisions at a European level for processing operations that may impact individual rights. Therefore, the agency has requested that the issue of ChatGPT be included in the next Plenary of the European Data Protection Committee to enable harmonized actions under the framework of the General Data Protection Regulation.
On Tuesday, France’s privacy watchdog also announced that it was investigating complaints about ChatGPT. Meanwhile, Italy’s data regulator has been reviewing the measures proposed by OpenAI in response to concerns that led to a temporary ban on the chatbot on March 31. The Italian regulator’s board held a meeting on Tuesday to discuss the matter.
Amidst worries regarding its effects on national security and education, the Biden administration has made public its request for feedback from the public on accountability measures for AI systems. The Center for AI and Digital Policy (CAIDP) has lodged a complaint with the US Federal Trade Commission (FTC), alleging that OpenAI’s latest product, GPT-4, violates federal consumer protection law and poses significant dangers to the public.
China has already drafted a set of rules for regulating generative AI services. Chinese regulators stated that these services must align with Chinese socialist values and avoid producing content that promotes regime subversion, violence, pornography, or disrupts social and economic order. Providers must ensure data legitimacy and prevent discrimination during algorithm design and training. In addition, generative AI service providers must undergo security assessments before launching their products.
